REQUEST FOR RELEASE OF FUNDS
On or after August 26, 2013 the City of Independence will submit a request to the Department of Housing and Urban Development for the release of Community Development Block Grant Funds (CDBG) under Title 1 of the Housing and Community Development Act of 1974, as amended; and HOME Funds under the National Affordable Housing Act of 1990, as amended, to undertake the following:
Project Title: Truman Heritage Habitat for Humanity Mt. Washington Housing Development Project
Purpose: Development of two single-family homebuyer opportunities for low-income households
Location: Mt. Washington Neighborhood (Census Block Group 110.003) Estimated Cost: $221,500.00
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for these projects are on file at the City of Independence Community Development Department, 111 E. Maple, Independence, MO and may be examined or copied weekdays 8:00 A.M to 5:00 P.M.
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Christina Leakey in the Community Development Department 111 E. Maple, Independence, Missouri 64050. All comments received by August 25, 2013 will be considered by the City of Independence prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Independence certifies to Department of Housing and Urban Development that the City of Independence and Robert Heacock in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Department of Housing and Urban Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Independence to use Community Development Block Grant and HOME Program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Department of Housing and Urban Development will accept objections to its release of funds and the City of Independence's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Independence; (b) the City of Independence has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Department of Housing and Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Department of Housing and Urban Development area office, 400 State Avenue, Kansas City, Kansas 66101. Potential objectors should contact the Department of Housing and Urban Development to verify the actual last day of the objection period.
